Nuremberg Mentality

Postby Spartakus » 1 decade 6 years ago (Thu Feb 26, 2004 7:33 pm)

I have made comments before on the propensity of Holocaust supporters to accept the most ludicrous evidence as 'proof' -- proof that would not stand up to normal, unbiased scrutiny by even professional historians but 'proof' that cannot be challenged, the truth of which is accepted as gospel without critical enquiry. I have referred to this as 'Nuremberg Mentality' as it was in Nuremberg that this propensity saw its first origins. A very eloquent example of this was the case of Julius Streicher who was charged, convicted and executed for Crimes Against Humanity based on 'evidence' no sane person would ever have accepted. No matter that Streicher never held a post in the National Socialist government and that he had been removed from the National Socialist Party in 1940. In addition, no credible link was found to implicate Dr. Streicher directly in any so-called 'mass murders'. No one was produced who stated that because of whatever Julius Streicher wrote, they went out and ordered the extermination of Jews. As a matter of fact, nothing Streicher wrote was ever linked to official National Socialist Government policies. Reading over the testimony at Nuremberg, all the prosecution could do was produce excerpts from the newspaper Israelitisches Wochenblatt which Streicher claimed to have subscribed to - excerpts that claimed mass shootings, executions etc. of Jews which they said constituted sufficient 'proof' that Dr. Streicher was informed as to what was going on but did nothing to stop it and indeed, continued to incite 'murder' in his own newspaper Der Sturmer which, incidently, was not an official government organ of any kind. Dr. Streicher dismissed the claims of the Israelitisches Wochenblatt as nothing but propaganda but 'Nuremberg Mentality' dictated that this was not an acceptable argument for the defence. It was on such a flimsy and ludicrous basis that Julius Streicher was executed for so-called Crimes Against Humanity. He died bravely, damning his executioners who rigged the hanging so that he would not die quickly but rather would slowly strangle to death. Some witnesses claimed they heard him groan quite audibly through his black hood and that it took over 15 minutes for him to die. A sad fate for one of the first victims of 'Nuremberg Mentality'.

The Charter of the International Military Tribunal permitted the use of normally inadmissible 'evidence.'

Article 19 of the Nuremberg Charter specified that:
"The Tribunal shall not be bound by technical rules of evidence... and shall admit any evidence which it deems to have probative value."

Article 21 of the Nuremberg Charter stipulated:

The Tribunal shall not require proof of facts of common knowledge but shall take judicial notice thereof. It shall also take judicial notice of official governmental documents and reports of the United [Allied] Nations, including acts and documents of the committees set up in the various allied countries for the investigation of war crimes, and the records and findings of military and other Tribunals of any of the United [Allied] Nations.

Given this acceptance of 'evidence' where no proof was ever established, it is clear there were few options for anyone accused, as what they were accused of was already accepted as fact.
Any 'document' or accusation presented by any of the Allied Nations was accepted as fact, without proof.
Also, one must remember that in many countries today it is illegal to question the show trials of Nuremberg.

If it can't happen as alleged, then it didn't.
